Article 1: object

The present conditions of sale govern the contractual provisions relating to the sales of the company MySim, 7 Rue Honore d'Estienne d'Orves, 92150 Suresnes of electronic communications services allowing according to the pack to be able to send or to receive calls and or to send receive SMS and / or use of data (internet).

 

Article 2 - Price

The SIM card remains the exclusive property of the company MySim.

Article 4 - Validation of your order

You declare to have perfect knowledge.

Article 5 - Payment

The fact of validating your order implies for you the obligation to pay the indicated price.

The debit of the card is made at the time of the order.

 

Article 6 - Retraction

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a 14-day right of withdrawal from receipt of the SIM card to exercise your right of withdrawal without having to give reasons. nor to pay a penalty.

Returns are to be made in their original condition and complete. In this context, your responsibility is engaged. Any damage to the SIM card may be likely to defeat the right of withdrawal. On the other hand, the customer will not be able to take advantage of the right of retractation in case of use of the service. The expenses of return are at your expense

In case of exercise of the right of withdrawal, MySim will refund the amounts paid, within 14 days of notification of your request and by the same means of payment as used in the order.

In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to refills.

 

Article 7- Availability

Our services are offered as long as they are visible on https://www.mysim-online.com and within the limits of available stocks.

In case of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.

In addition, MySim is not intended to sell its products in significant quantities.

Therefore MySim reserves the right to refuse orders in abnormally high quantities.

 

Article 8 - Delivery

The products are delivered in 48h except weekends and holidays to the delivery address (Metropolitan France) indicated during the process of order.

In case of delay of shipment, an email will be sent to inform you of a possible consequence on the delivery time that has been indicated.

In accordance with the legal provisions, in case of late delivery, you have the possibility to cancel the order under the terms and conditions defined in Article L 138-2 of the Consumer Code. If in the meantime you receive the product we will proceed to its refund and shipping costs under the conditions of Article L 138-3 of the Consumer Code.

In case of deliveries by a carrier, MySim can not be held responsible for late delivery due exclusively to the unavailability of the customer after several proposals for appointments.

Article 9 - Guarantee

In the event of a defective SIM card (and unused credit), the customer may request a free replacement.

In case of loss or theft, the customer must inform MySim as soon as possible in order to freeze and free replacement of the SIM card. (unused credit)

The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

 

Article 10 - Period of validity of the SIM card, initial credit and recharges.

MySim SIM cards are valid for a variable sliding period depending on the operator selected from the date of first connection to the mobile network (details in the product sheet). At the end of this period, we reserve the right to disable the SIM card. The initial credit and refills are valid and are non-refundable.

 

Article 11 - Liability

The services offered comply with the French legislation in force. MySim can not be held liable for failure to comply with the law of the country where the service is used. It is your responsibility to check with the local authorities the possibilities of using the services you plan to order.

In addition, MySim can not be held responsible for damages resulting from misuse of the service.

Lastly, MySim can not be held liable in case of force majeure and for any inconvenience or damage arising from the use of mobile and internet networks, including a break in service, external intrusion or the presence of computer viruses.

 

Article 12 - Applicable law in case of disputes

The language of this contract is French. These conditions of sale are subject to French law. In case of dispute, the French courts will be the only competent.

 

Article 13 - Intellectual property

All elements of the site https://www.mysim-online.com are and remain the intellectual and exclusive property of MySim. No one may reproduce, use, repost, or use for any purpose whatsoever, even partially, elements of the site that are software, visual or sound. Any single link or hypertext is strictly prohibited without the express written consent of MySim.


Article 14 - Personal data

Under the Agreement, MySim acts as a reseller and, as such, processes the Customer's Personal Data. Personal Data collected by MySim or its partners are processed in accordance with the provisions of the Data Protection Act No. 78-17 of 6 January 1978 as amended and Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data.

The Personal Data processed by MySim concern the data communicated by the Customer when subscribed and updated on his client area throughout the duration of the Agreement. The processing of Personal Data is for the purpose of managing the contractual relations between MySim and the Customer as part of the Offer and any marketing actions and promotions offered by MySim to Clients who have given their consent. The use of certain Personal Data is strictly necessary for the performance of the Agreement or is in the legitimate interest of MySim or is the result of a legal obligation or is based on the consent of the Customer. Personal Data strictly necessary for the performance of the Contract is collected directly from the Customer.

If this Personal Data is not disclosed, MySim will not be able to conclude the sales contract or the requested service.

MySim strives to customize its services to best meet the expectations of its customers. In this context, MySim is required to collect and process directly or indirectly if the laws in force require it, with the consent of the person concerned, Personal Data not strictly necessary for the performance of the Contract and this, in order to better know its Customers and to be able to offer them the most relevant offers.

Article 14.1 - Retention period

The Personal Data collected is retained only for the time necessary to achieve the purposes described above, within the limitation period in force.

Article 15 - Archiving Proof

MySim will archive the purchase orders and the invoices on a reliable and durable support constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized records of the company MySim will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
